- Search
Reports - Each search is accompanied by a search
report that may be customized to your specification.
Our standard detailed report includes a concise
description of the search scope, identification
of the field of search for manual searching,
identification of databases accessed and search
parameters or queries used for automated searching,
identification of Examiner's consulted (where
applicable), a listing and a copy of each reference
found, and a discussion of the references found.
Expanded
Validity Searches:
When
a "traditional" validity search of patents,
commonly used databases and literature maintained
in the Examiners' search rooms does not uncover
invalidating prior art, we can design and
execute a more comprehensive invalidity investigation
of some "non-traditional" sources. This investigation
may include an in depth analysis of pioneering
work for the relevant subject matter. The
investigation can focus on finding individuals
who may have knowledge of work in the relevant
art to identify potential on-sale bars, public
uses, disclosures or displays, non-traditional
publications, etc.
Such investigations may include:
- identifying
and interviewing professors from Universities
engaged in research concerning the subject
matter of the patent;
- locating
and interviewing inventors or authors listed
on the most relevant patents and publications;
- identifying
and contacting companies that may have commercialized
the relevant technology;
- identifying
and locating materials from seminars, conferences
or grant applications concerning the relevant
subject matter;
- identifying
relevant trade associations and their journals,
and contacting the heads of the associations
to identify relevant facts;
- conducting
searches for trademark applications of the
trademark owner that may suggest commercial
activity prior to the critical date;
- reviewing
all references cites during prosecution
of the most relevant patents found as a
result of the initial search and performing
a search forward for all patents that cite
the most relevant patents;
- reviewing
the references contained in the bibliographies
of all relevant publications found as a
result of the initial search;
- identifying
other countries in which the relevant technology
was developed or commercialized and coordinating
searches with our foreign associates in
those countries; and
- other
investigations as the fact may warrant
